The Trade In Program "Set for Set" for the IQOS ILUMA device: Program Rules

1. Application of these Program Rules

1.1. These program rules ("Rules") apply to and regulate your participation in the Trade In program ("Trade In") to exchange your IQOS 2.4 or IQOS 2.4Plus or IQOS 3 or IQOS 3 DUO or lil SOLID ("device") or IQOS ORIGINALS DUO for a new IQOS ILUMA device. These Rules need careful reading as they affect your rights and regulate the relationship between you and Philip Morris BH d.o.o. Sarajevo.

1.2. You are only eligible to this Trade In if:
(i) you are an IQOS user aged over 18 years old;
(ii) you and your Device are registered in PMI’s database;
(iii) your main residence is in Bosnia and Herzegovina; and
(iv) your Device is not disarticulated and comprises of the charger and holder (which are each in one part).

1.3. You are not required to possess the charging cable, original box or other accessories complimentary to the Device to participate in Trade In.

1.4. You may register yourself and your Device in our database at iqos.com, by calling Customer Care on the 0800 21 2 12, meeting our IQOS coach or at IQOS stores https://ba.iqos.com/en/stores/locator.

1.5. By participating in Trade In, you agree to be bound by these Terms. If you do not agree or cannot comply with these Terms, then you are not permitted to participate in the Trade In. No modification of these Terms by you is permitted unless Philip Morris BH doo Sarajevo expressly agrees in writing.

1.6. Your participation in the Trade In is at our discretion and we may refuse your application to participate, or we may terminate your right to participate in the Trade In for any reason including if you breach any of these Terms.

1.7. We also reserve the right to amend these Terms upon notice at any time. If you do not agree to any such amendments, you may not participate in the Trade In.

2. Trade In conditions

2.1. To participate in the Trade In, you need to visit one of the official IQOS stores (“IQOS Stores”), website iqos.ba or contact IQOS coach. The current list of IQOS stores is available at: https://ba.iqos.com/en/stores/locator

2.2. The Trade In program allows you to get a discount when purchasing an IQOS ILUMA device in exchange for your current device (which should include a pocket charger and holder).

2.2.1. The discount may vary depending on offer and price changes.
2.2.2. Trade In offer cannot be used on device purchase through trade in during the same calendar year.

2.3. For the purposes of this clause, the Devices with the following circumstances are not acceptable for the Trade In:

(i) Damage caused by abuse or misuse, or actual, or attempted, modification or alteration of the Device, power surge.

(ii) Devices with a serial number that has been altered, defaced or removed.

(iii) Devices that have been opened, serviced, modified or altered in a manner not authorized by Philip Morris BH doo Sarajevo.

(iv) Devices who are in lending program (or any other program where device is not in consumer`s ownership);

2.4. In accordance with Section 2.2. of these Terms, participating with a device of a specific color (especially limited edition releases) does not guarantee the use of a discount for purchasing the IQOS ILUMA kit in a specific color.

2.5. An IQOS user with at least one registered device can exchange a maximum of two devices in the same calendar year until the launch of a new series of devices.

2.6. Trade In for IQOS Club members

Terms and conditions are applicable to IQOS Club members in Trade In program depending on your current status:

i. IQOS Club member with Silver status can participate in the Trade In program and make two exchanges of old for new until the launch of a new series of devices at a price of 159 BAM (for IQOS ILUMA PRIME device), 79 BAM (for IQOS ILUMA ONE device), and 49 BAM (for IQOS ILUME ONE device). A member with Gold status at a price of 159 BAM (for IQOS ILUMA PRIME device), 79 BAM (for IQOS ILUMA ONE device), and 49 BAM (for IQOS ILUMA ONE device). If an IQOS Club member of this status has at least one registered device, it is possible to exchange up to two devices for new ones. The device purchased through Trade In in the same calendar year is not eligible for re-exchange old-for-new in the next 12 months.
ii. IQOS Club member with Platinum status can participate in the Trade In program up to two times a year until the launch of a new series of devices and replace the old IQOS device with a new IQOS ILUMA device for a price of 159 BAM (for IQOS ILUMA PRIME device), 79 BAM (for IQOS ILUMA ONE device), and 49 BAM (for IQOS ILUME ONE device).
iii. In case of one participation in the Trade In program at lower statuses, you have the right to participate again after upgrading to Platinum status at the following prices: 159 BAM (for IQOS ILUMA PRIME device), 79 BAM (for IQOS ILUMA ONE device) , and 49 BAM (for IQOS ILUME ONE device).

3. Term and Termination

3.1. These Rules and conditions apply to any purchase of the IQOS ILUMA kit until further notice.

3.2. Participation in the Trade In program depends on the availability of the IQOS ILUMA kit at the sales location.

4. Miscellaneous

4.1. As your participation in the Trade In is free of charge, it is provided ‘As Is’ and without any warranty.

4.2. Philip Morris BH doo Sarajevo shall not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your participation in the Trade In.]

4.4. These Terms are subject to the laws of the registered office of Philip Morris BH doo Sarajevo. Any legal dispute will be subject to the exclusive jurisdiction of the city in which Philip Morris BH doo Sarajevo has its registered office.
